If you file your claim more than 6 years after initial eligibility, you will be restricted to 6 years of any retroactive entitlement. In accordance with specific guidance, the CRSC program provides compensation for certain Uniformed Service Retirees with combat-related disabilities.

Special rules regarding Chapter 61 Retirees : Disability Retirees even those with less than twenty years of service are eligible for CRSC but the rate of payment will be reduced by the difference between retired pay based upon disability and retired pay for years of service.

You may be eligible for CRSC if you currently receive military retired pay and meet one of the following criteria:. Also, retirees who combine their military and civil service retirements are not eligible for CRSC.

You may be eligible for CRSC with a combat-related disability, but in order to be paid compensation, you must have an offset to your retired pay for VA disability compensation. Therefore, you must obtain a VA rating and be receiving disability compensation in order to qualify.

A reserve or guard retiree must be 60 years old and in receipt of retired pay in order to be eligible to receive CRSC. Once your branch of service processes your claim, they will notify you in writing of approval or denial of your application.

If approved, a copy of your approval letter will be forwarded to DFAS. Once DFAS receives the approved award letter, payment will be initiated within approximately 60 days. CRSC is considered special compensation and therefore not subject to the rules and regulations governing military retired pay, including court-ordered division of pay.

If your former spouse receives a portion of your retired pay and you are awarded CRSC that will stop. You will have to make payments in another manner or be in violation of the divorce settlement. CRSC payments stop on the last day of the month prior to the retiree's death. However, the deceased retiree's designated beneficiary is entitled to any unpaid CRSC due at the time of death.
